Exclusions and Limitations of Liability
Please read these Terms and Conditions carefully before using the CDRA website and services operated by CDRA
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you do not have permission to access the Service.

Exclusions
- More than one service per incident and/or more than one tow per disablement and repeated service calls for a vehicle that needs
- maintenance or repairs;
- More than one boost per incident;
- Shoveling snow to free or access a snowbound vehicle. It is your responsibility to make sure that there is a free path to your vehicle;
- Cost of any mechanical repair including but not limited to installed parts, labor, supplies or materials. This includes installation and removal of new tires or snow tires, chains, etc.;
- Towing a vehicle from a repair facility because you do not approve the quoted repair cost or the facility’s normal hours of operation;
- Tires cannot be inflated under any circumstances;
- Transporting you to your disabled vehicle or to your home or to the garage after the service has been rendered;
- Service to any vehicle not driven on a public or private highway, or willfully driven into non-regularly traveled areas such as non-recognized roads, open fields, construction sites, beaches, mud-filled areas, driveway/laneways, concession roads, vacant lots, or any other area that is inaccessible (with regular towing equipment) or hazardous for the Service Operator’s vehicle to reach;
- Service to motorcycles, motor scooters, recreation vehicles, commercial vehicles, all-terrain vehicles, snowmobiles, dune buggies, trailers of any description, taxicabs, rentals, tractors, boats, vehicles used for competition, unlicensed vehicles, and impounded or theft recovered vehicles;
- Vehicles in storage, seasonal vehicles, idle vehicles for more than a month, not in good condition and/or not properly maintained;
- Towing and road services applicable to insurance claims whether you will file a claim or not. (e.g. accident related roadside assistance and/or towing, vandalism, fire, etc.);
- Towing a vehicle to a scrap yard;
- Service to unattended vehicles (a licensed driver must be present when service is being rendered);
- A slow battery charge;
- Any vehicle of more than 12 vehicle years of age. We will consider a vehicle more than 12 vehicle years old from the date of manufacture marked on the vehicle’s V.I.N. (Vehicle Identification Number) plate to the time of enrolment of the vehicle or Policyholder in the Emergency Roadside Assistance Plan;
- If a Policyholder has a current Roadside Assistance Plan with any automobile manufacturer or any other roadside assistance provider, then the other Roadside Assistance Plan must be used exclusively before the Policyholder can use any services provided by the Emergency Roadside Assistance. Emergency Roadside Assistance must be used and considered as an emergency service of last resort.
Limitations of Liability:
CDRA’s Emergency Roadside Assistance provides emergency road service through a comprehensive network of Service Operators across North America. However, it should be understood that the CDRA’s Emergency Roadside Assistance program is restricted to the coordination of roadside services on behalf of the Policyholders of the program as well as payment and/or partial payment for such services all in accordance with the terms and conditions of enrolment (herein, the Program). Notwithstanding that the Providers of the Program coordinate the services to be provided by a Service Operator to a particular Policyholder of the Program, the actual Service Operators are independent business owners and, therefore, the Emergency Assistance Program remains separate and distinct from the independent business entities that provide the actual roadside services (herein, the Service Operators).
Accordingly, the Providers of the Program shall not assume any liability for any loss or damage whatsoever, including but not limited to property damage or loss of property, including loss or damage to a Policyholder’s vehicle or any other vehicle; personal damage and/or personal injury to the Policyholder, the Policyholder’s family or any other individual; loss of time and /or inconvenience; any expenses incurred by the Policyholder, including expenses for the rental, replacement and/or purchase of a vehicle; any other special, incidental, consequential or punitive damages; any punitive loss or any other damages arising from any agency work undertaken by the Providers of the Program on behalf of a Policyholder; the coordination of services between the Service Operator and the Policyholder; the actual services provided by the Service Operator; a failure to fulfill the service agreement undertaken by the Service Operator for any services whatsoever whether or not the agreement was arranged through the Program.
The Providers of the Program shall not subrogate either the rights of the Policyholder to the Service Operator or the rights of the Service Operator to the Policyholder.
Service under Severe Weather Conditions:
When severe weather conditions prevail, service may be delayed because of heavy demands for Emergency Road Service. Emergency Roadside Assistance is not responsible for any costs related to delays caused by severe weather conditions including but not limited to any costs for alternate transportation, property damage, damage for delay or inconvenience. In addition, Emergency Roadside Assistance Policyholders calling from an exposed or unsheltered area will be given priority over Policyholders requesting service from a safe environment.
Reimbursement:
Before using the service, you are required to call 1-866-519-4001 to have our pre-authorization. The requests for service calls made without our pre-authorization will be treated with special attention. An exception may be made, at our discretion, for a maximum of $50 per call.
